Lemler IP has handled many copyright applications over the years. The process to copyright an article is very simple. In order to obtain a copyright, Lemler IP will contact the U.S. Copyright Office and follow a few steps. Lemler IP will provide a sample of what’s being copyrighted for them to keep in the Library of Congress. The symbol circle C is the copyright notice. It should list the year that the work was produced or the work was first created, followed by the name of the owner of the copyright.
The term of copyright protection depends upon the date of creation. If the copyright was created on or after January 1, 1978, protection is ordinarily at the moment of its creation until 70 years after the creator’s death. For contracted work, anonymous work, and pseudonymous works, unless the author’s identity is revealed in the Copyright Office records, the durational copyright is 95 years from publication or 120 years from creation, whichever is shorter.
For works created, published, or registered before January 1, 1978, the laws are more complicated. According to circular 15a on the Copyright Office website, the law automatically gives federal copyright protection to works that were created before January 1978. Depending on the nature of the authorship, the duration of the copyright can be life plus 70, 95, or 120 years. All works in this category are guaranteed 25 years of statutory protection at a minimum.
